PathWEH Terms and Conditions

Welcome to PathWEH. These Terms and Conditions (“Terms”) govern your access to and use of the PathWEH mobile application and related services (together, the “App”). PathWEH is a Bible study tool providing cultural context, historical insight, and guided reflection (“Services”).
By accessing or using the App, you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
To use PathWEH, you represent and warrant that you:
– Are at least 18 years old (or the age of majority in your jurisdiction);
– Have the legal capacity to enter into these Terms;
– Will use the App only for your personal, non-commercial, and lawful purposes.
The App is not available to individuals previously suspended or removed from it.
2. Account Registration and Security
Certain features of PathWEH require an account. By registering, you agree to:
– Provide accurate, current, and complete information at all times;
– Maintain the confidentiality of your login credentials and not share account access;
– Notify us immediately of any unauthorized use, suspected breach of security, or other account compromise at info@studyaloud.com.
You are solely responsible for all activity under your account, regardless of whether you authorized it.
3. Use of the App
PathWEH is intended solely for educational and personal Bible study. You agree to use the App only for:
– Accessing cultural, historical, and theological backgrounds for Scripture;
– Using private journaling and guided reflection prompts;
– Tracking your personal Bible reading and study progress.
Prohibited Conduct:
You agree NOT to:
– Reverse-engineer, decompile, modify, or copy the App (except as permitted by law);
– Use bots, spiders, or automated scripts to access, collect, or manipulate information;
– Upload or transmit any content that is unlawful, defamatory, abusive, offensive, or that infringes the rights of others;
– Interfere with, disrupt, or attempt to gain unauthorized access to any part of the App, user accounts, or servers;
– Use the App for any commercial purpose or for the benefit of any third party.
We may investigate and seek appropriate legal remedies for any breach of these Terms.
4. Intellectual Property Rights
All content within PathWEH—including text, illustrations, proprietary historical research, graphics, images, and logos—is the exclusive property of Study Aloud LLC or its licensors and is protected by copyright and other intellectual property laws.
Limited License:
PathWEH grants you a limited, non-transferable, non-exclusive, revocable license to access and use the App solely for your personal, non-commercial study and reflection.
Restrictions:
You may not reproduce, distribute, publicly display, adapt, create derivative works from, or otherwise use any materials from the App except as expressly permitted in these Terms or with prior written consent.
5. User-Generated Content
PathWEH allows you to create private content, such as journal entries and notes (“User Content”).
Ownership:
You retain all rights to your User Content.
Privacy:
User Content is stored privately, accessible only to you unless you export or share it outside the App. PathWEH does not feature public sharing, public posting, or community forums.
Limited License to PathWEH:
You grant PathWEH a limited license to store, process, and display your User Content solely to provide the requested service and App functionality. We claim no ownership or rights to see, use, or disclose your notes to others.
Responsibility:
You are solely responsible for your User Content and agree not to submit content that is illegal, infringing, harmful, or otherwise breaches these Terms.
Retention:
Upon deletion of your account, your User Content is deleted in accordance with our Privacy Policy.
6. Privacy
Your use of PathWEH is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Please review it carefully at studyaloud.com/privacy-policy.
7. Third-Party Services and Links
The App may contain links to third-party websites or services (“Third-Party Services”). These are provided for your convenience and do not signify endorsement. We do not control these services and are not responsible for their content, terms, or privacy practices. Use of Third-Party Services is at your own risk and subject to their terms and conditions.
8. Data Security
We employ reasonable administrative, technical, and physical safeguards to keep your personal data secure. While we endeavor to protect your information, no system can be completely secure. You are responsible for maintaining security of your account credentials and for any activity that occurs under your account.
9. Disclaimers
“As Is” Basis:
The App, including all cultural, historical, and study materials, is provided on an “as is” and “as available” basis, without representations or warranties of any kind, express or implied.
To the fullest extent permitted by law, PathWEH disclaims all warranties, including those of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of performance or usage of trade.
Not Professional Advice:
All content is provided for informational, educational, and spiritual reflection purposes. PathWEH does not provide medical, legal, psychological, or other professional services. You should seek advice from qualified professionals regarding any such matters.
10. Limitation of Liability
To the maximum extent permitted by law, PathWEH and PathWEH Inc. and their directors, officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits, loss of data, or other losses resulting from (i) your use or inability to use the App; (ii) errors, omissions, or inaccuracies of content; or (iii) any unauthorized access or use.
In no event will our aggregate liability to you exceed USD $50 or the amount you paid for using the App in the twelve months preceding any claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some limitations may not apply to you.
11. Indemnification
You agree, to the extent permitted by law, to indemnify and hold harmless PathWEH, PathWEH Inc., and their officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from your violation of these Terms, User Content, or misuse of the App.
12. Termination and Account Closure
PathWEH may suspend, terminate, or restrict access to your account or any part of the App at our discretion, with or without notice, if you violate these Terms, misuse the App, or if required by law.
You may close your account at any time using the App settings or by contacting us at: Info@studyaloud.com. Upon termination by either party, your right to use the App immediately ceases, and your content will be deleted in accordance with our Privacy Policy.
Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, governing law, and dispute resolution) will remain in effect.
13. Governing Law, Jurisdiction, and Dispute Resolution
Governing Law:
These Terms are governed by and construed in accordance with the laws of the State of Illinois, USA, excluding its conflict of law provisions.
Dispute Resolution & Arbitration:
We strive to resolve any disputes amicably. If a dispute cannot be resolved informally, you and PathWEH agree to submit any claim, dispute, or controversy to binding arbitration in Illinois administered by a reputable arbitral body. Arbitration will be on an individual basis only. You waive any right to participate in class action or representative proceedings.
Nothing in this section prevents either party from seeking injunctive or other equitable relief for a breach of intellectual property or confidentiality obligations.
14. Force Majeure
We are not responsible for any delays or failures arising from events outside our reasonable control, including but not limited to acts of God, natural disasters, failures of public networks, power outages, or government actions.
15. Modifications to Terms and Services
We reserve the right to update or change these Terms at any time. We will post the revised Terms within the App or notify you via your registered email. Your continued use of the App after notification of changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must cease using the App.
We may modify or discontinue any aspect of the App at any time without liability to you.
16. Miscellaneous
Severability:
If any provision of these Terms is deemed invalid or unenforceable, the remaining Terms remain in full force and effect.
Waiver:
No waiver by PathWEH of any right or provision will be deemed a waiver of future rights or provisions.
Assignment:
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, sale of assets, or similar transaction.
Entire Agreement:
These Terms, along with the Privacy Policy, constitute the entire agreement between you and PathWEH regarding your use of the App.
